Q. Mr. Mead, where do you live at?
MR. DUNGAN: Your Honor, before we get into his testimony, I just want to indicate and put an objection on the record that this individual has been sitting through substantial portions of this trial since we started, including after the prosecutor rested. There’s a number of people sitting here that have seen him in the courtroom.
THE COURT: I’ve never seen him before.
MS. LAMP: Your Honor--
THE COURT: Go ahead.
MS. LAMP: Mr., and I should have brought that to the court’s attention and I apologize for not having done that. Mr. Mead was in the courtroom, but at the time that he was in the courtroom I had not contemplated him as a witness and knew nothing about him and it was after the time that I spoke with him I asked him to exit the courtroom and at that time he was not in the courtroom, but at the time that he was here he was not a potential witness.
