Torture charges dismissed in horse case

There is no evidence the owner or manager of a Grass Lake Township farm intended to harm the three horses they are charged with torturing, a judge said today.

In a written opinion, Circuit Judge Chad Schmucker dismissed the three felony torture charges against owner James Henderson Jr. and manager Matthew Mercier.

In an obvious attempt to stop the truth from spreading JCAC has been issued a Personal Protection Order(PPO) against Matt Mercier, Notice the statement hand written in the other column "Using computer or website ...".

Here's what is going on now.
 
Yesterday I went to Ratcliff's property (the first rescue group) in Columbia Township to check on it and help clean it up for her as her daughter is dying and the renters are trashing the property without paying rent.
 
The neighbor knew who I was and was mad that they got caught not paying rent and had to pay me to give to them.  He was mad also because he has been using the other side of the farm and got caught.
 
Anyway, police come.   Make sure we (my parents and I) are allowed to be there via a phone call to the owner of the property (Patsy Ratcliff).  Brad (owner's son in law) shows up and again verifies I am allowed to be there and am cleaning the place up.  Police leave without incident.
 
The neighbor calls Jennifer Lamp and AC and is told I am not allowed to be 300 feet from any of the horses.  They have a Turn-3 horse they purchased from the auction.  Lamp and AC tell her that SHE has to tell me to leave the property!  She calls me all sorts of names including animal abuser and screams at me then leaves after taking my picture with her cell phone.  She calls and apparently made a police report that I threatened her and harrassed her and said I was going to take her horses!  Apparently her 13 year old daughter (who I have never even seen) is scared of me!  This is what she told Columbia Township.  Her rental farm is ACROSS the road!  AND there were 3 witnesses there with me!
 
Jennifer Lamp and AC call Patsy Ratcliff and tell her she is NOT allowed to have me on the property or rent the property to me and that I'm dangerous and need to stay away from me!  She tell them where to go basically. 
 
This morning the Columbia Township PD calls Patsy and tells her that she can't rent to me, I'm dangerous, to stay away from me and they better "fire me".  They tell her that they will escort me off the property if she wants them to.  Again, she tells them where to go.
 
They are trying to stop me from going to a place where horses are across the road!  And because  Patsy hired me to clean up the property, they are trying to get me fired.  Telling all sorts of lies (such as a court order saying I have to stay away) to the general public!
 
This is not the first example of this.  They have told the Kauffman's (Springport Township "case") personal information about me and how I'm dangerous.  Laura Steenrod called MSU Campus Police and told them I was threatening and interfering with the Veterinarians.  They called the State Police and filed a false police report saying I threatened AC.  They have had me harrassed at the auction by Napolean PD.  AC and Jennifer Lamp have told all sorts of people lies and more lies.
 
This is out of control and I'm about to go file a lawsuit against Columbia Twshp PD for harrassment and slander.  Someone needs to educate Hank Zavislack on how a Prosecutor is supposed to work.  Lamp and AC are out of control!  Now they think they can tell me where I can work and whose private property I can go on????????  Who the hell do they think they are?
 
A 70 year old woman sitting there with her daughter dying of brain cancer is receiving harrassing phone calls from Jackson County, AC and Columbia Township.  Let a jury hear that!

Turn-3 Ranch has submitted a bill to Jackson County for $120,000.00+ for board and property rental at this time.

The government had the right to seize the horses and remove them from the property within 72 hours.

They did NOT have the right to remain illegally on the property for countless months!  It is analogous to a drug seizure or child abuse case.  They can seize the item (house/car/boat/child etc...) but that does NOT give them the right to move in, drive the car/boat etc...

The response will be noted.  Turn-3 Ranch was more than fair in the board bill.

A judge Friday ordered the owner of a herd of horses seized by Jackson County to turn over ownership records to prosecutors so the animals can be sold.

District Judge Joseph Filip gave James Henderson one week to comply, or face contempt.

Filip earlier ordered more than 80 horses forfeited after Henderson failed to post a $134,614 bond.

Henderson and herd manager Matthew Mercier face an Oct. 8 trial in Circuit Court, each on three felony counts of animal torture.

The Jackson County Animal Control department took control of the Grass Lake Township farm based on an investigation of alleged abuse and neglect of horses last winter.

The herd initially included 69 adult horses.

More than a dozen foals have been born since.

All are under the county's care, at considerable expense to the county.

The county plans to sell the horses, possibly in September, and needs breeding records, registrations and other paperwork to realize the horses' full value.

Two stallions, for instance, are pedigreed and registered and are worth at least $10,000 each with proper documents, prosecutors say.

Assistant Prosecutor Jennifer Lamp argued Friday the documents were vital to the sale.

Filip said the forfeiture statute did not stipulate that paperwork goes with the animals.

He consulted Black's Law dictionary for a common language definition indicating forfeiture includes title to the property.
