Lamp throws a fit about Rescue Group being away for cancer treatment.  They did this same thing when Matt was in Rollover car accident! 

 

THE COURT:  Okay.  I cheated you guys out of lunch last time, I won’t do it again.  But half hour?  Are you still on the two thirty?  I’m still on the two thirty finish today because my hearing is at two thirty with another attorney on a drinking and driving case.

              MR. DUNGAN:  I think we’re okay.

              THE COURT:  Think we’re okay with a half hour now?

              MR. DUNGAN:  Yeah.  We’re not going to finish today no matter what because I got those--

              THE COURT:  You’ve got your other cancer person, okay.

              MS. LAMP:  I’m not aware, nobody shared that we would be going, if I could inquire so I would know what else has been communicated.

              THE COURT:  Well, I said we’re stopping at two thirty because I got a hearing--

              MS. LAMP:  I don’t know anything about a cancer  horse that you guys, or cancer doctor that’s coming in to testify.

              THE COURT:  Not a cancer doctor, a cancer client, person.

              MR. DUNGAN:  Brad and Kim Ratcliff that we’ve been talking about.

              MS. LAMP:  Have there been some arrangements made for us to…

              THE COURT:  To what?

              MS. LAMP:  To take their testimony on a different day?  I don’t understand what we’re referring to.

              THE COURT:  We haven’t got that far yet.  I was just inquiring if he was on still for two thirty today to finish with what witnesses you have.

              MR. DUNGAN:  Yes.

              THE COURT:  And we’ll take till twelve twenty-five for lunch and be back.

              MR. DUNGAN:  Right.

              THE COURT:  And then the issue of the man and wife, the wife has the cancer problem and she’s not available for some time I guess, what you were saying.

              MR. DUNGAN:  They are scheduled to be back from Chicago on the twenty-sixth.  And Chicago is where she is receiving treatment.

              THE COURT:  Okay.

              MS. LAMP:  Your Honor, as I understood it, I thought Mr. Dungan had indicated that we would complete testimony on Friday and then I understood it when we rescheduled for today that he—-I’m just trying to make sure that I understand so I can schedule appropriately, that I thought we were completing his proofs today.  Has something changed that I’m not aware of so that I can understand what our time frame is?

              MR. DUNGAN:  Yeah, Chicago won’t let the cancer lady come home right now.  Something about radiation treatments and saving her life, she’s just going to have to be there till the twenty-sixth.

              THE COURT:  And I’m not, I don’t disagree with you, Miss Lamp, as far as what perhaps my understanding was, but because of the situation that developed Friday and also with this witness here, I think probably we can manage to have another day where those persons are available.  You need to get some definite date for us, Mike, as far as that goes.

              MR. DUNGAN:  I will.

              MS. LAMP:  I just wasn’t aware of that.

              THE COURT:  You have schedules, the court has schedules too as to other people and we want to, absent acts of God or accidents, we want to get done.  Certainly the forfeiture side.  I don’t know if you’re presenting testimony on the felony side at this particular point, I suspect not, but….

              MR. DUNGAN:  The court can always consider it.

              THE COURT:  Sure.  Okay, twelve twenty-five, folks.

              MS. LAMP:  Thank you, Your Honor.

              THE COURT:  Thank you.
