On 5/16/08 Judge: Horse forfeiture was improper
Circuit Judge Thomas Wilson made the ruling in the case
On 4/30/08 Circuit court
Judge Chad Schmucker dismissed the three felony torture charges
against Matt and Jim. There is no evidence they intended
to harm the three horses they were wrongfully charged with
torturing.
On 7/20/07 Judge Joseph Filip of 12th District Court set
a HORRIFIC precedent for the future of Livestock Owners and Pet Owners
across America. Judge Filip ruled on the Turn-3 Ranch civil forfeiture
case. His ruling set forth that Animal Control and County Government
can move in and SEIZE EVERYTHING a livestock owner has worked his life for.
This can be done, via Filip's ruling, for easily fixable issues. All
of the following happened at Turn-3 Ranch and were testified to or proven in
picture evidence of Prosecutor Jennifer Lamp. It
includes the following:
- Animal Control's OWN veterinarian can say it is NOT
an abuse case, and they will ignore that person
- Animal Control's OWN veterinarian can say give you a
warning and monitor, they will ignore that person
- Animal Control Officers can PERJURE and lie to
judges, and still get a warrant and have it be upheld
- Animal Control Officers can call a RESCUE GROUP in
who tells them it is NOT an abuse case, and they will be ignored
- Animal Control can call a group like Leelanau
Horse Rescue, who will tell them what they want to hear, after they kick the 1rst
off
- Animal Control can call the media out after flooding
your barn and moving horses into the mud and claim you did it - they
will plaster this all over the news stations and front page in the paper
- If your run-in sheds or barn are not PRETTY and need
repair, you are not providing adequate shelter
- If your 24 and 25 year old mare lose weight in a
tough Michigan winter, you are not providing adequate feed
- If your animal injures itself and you doctor it
before having a veterinarian look at it, you are not providing adequate
medical attention
- Even if you make 2 appointments that Animal Control
themselves cancel, you are neglecting the animal
- Animal Control can call and verify with your feed
suppliers and ignore them
- If your equipment breaks and is in the process
of being repaired and you get behind on cleaning some things up, you
will lose everything
And the worst of all: Animal Control, despite
evidence contrary, can BARGE in and SEIZE everything you have worked your
life for. They can kick you off the farm, take your pick-up trucks,
horse trailers, saddles, equipment, tractors and all of your animals and not
let you have a say in their care. You WILL be banned from the property
with the constant threat of JAIL while the "volunteers" they call in steal
everything left behind. Animal Control can get away with injuring and
starving your animal (see How Jackson County took care of the horses) and YOU will be charged with FELONY TORTURE!
You will spend 10's of thousands of dollars to clear your name.
Meanwhile...you have lost EVERYTHING! Jackson County Animal Control Officer
Heather Wheaton is the "lead investigator" for the Turn-3 Ranch. It is
our understanding that Animal Control Officers HAVE TO have a Sheriff Deputy
or the owner of the animals with them at all times on the property.

property on 3/14/07. No Sheriff Deputy parked anywhere!
This is not the only time she has been
alone. On the night of 3/20/07 Mr. Mercier and his friends were
asked to follow the Sheriff Deputy out of the property. Heather
Wheaton and her CIVILIAN husband were left alone on the property for
endless hours! |
